Un deber ciudadano es respetar la Constitución. Un respeto que resulta ser un mandato imperativo para órganos estatales como el Ministerio Público. Rol que para el Tribunal Constitucional no fue respetado por la Fiscalía, que al negarse a entregar una copia del acuerdo de colaboración eficaz con Odebrecht violento la Constitución.
Esto en torno a la sentencia N° 02901-2024-PHD/TC emitida a razón de la demanda de habeas data presentada por Edward Phillip Alexander Butters Rivadeneira. La Fiscalía negó entregar una copia del acuerdo de colaboración suscrito en el 2019 con la transnacional. La demanda fue declarada improcedente por un juzgado y sala constitucional del Poder Judicial.

En el fundamento 34 de la sentencia los magistrados precisaron que el Ministerio Público violento el derecho constitucional de libre acceso a la información pública, al justificar su negativa de entregar información amparándose en un reglamento referido al proceso de colaboración eficaz. A decir de los magistrados la Fiscalía pretendió superponer lo dispuesto por un reglamento a lo previsto por la constitución.
El mencionado reglamento es el Decreto Supremo N° 007-2017-JUS. El numeral 7 del artículo 2 precisa que el proceso sólo debe ser conocido por los vinculados al caso. Es decir, el Fiscal, el colaborador y su abogado, el agraviado y el juez.
Fiscalía no respeto la supremacía constitucional
A decir de los magistrados del Tribunal Constitucional la norma en ese extremo resulta ser violatorio del texto constitucional. Según el artículo 51 de la carta magna, la Constitución prevalece sobre cualquier norma legal.
De allí que concluyen que la libertad de solicitar información y recibirla de cualquier entidad pública mencionado en el inciso 5 del artículo 2 de la Constitución, es un derecho que no puede ser vulnerado por un reglamento, salvo situaciones previstas en el artículo 15 de la Ley 27806 de Transparencia y Acceso a la Información Pública.
En tal sentido el reglamento del proceso de colaboración eficaz o incluso lo indicado en el artículo 324 del Código Procesal Penal, referido al carácter reservado de la investigación, no tiene la jerarquía para superponerse al derecho de libre acceso a la información.
Los tribunos además, indicaron que el acuerdo de colabora eficaz fue aprobado por una sentencia judicial y fue publicado en parte por el Poder Judicial. Esta difusión de secciones del documento y otras realizadas por otros medios de comunicación quitan el carácter de reservado al documento.
Fiscalía debe entregar copia del acuerdo de colaboración
En su parte resolutiva la sentencia del Tribunal Constitucional, ordena al Presidencia de la Junta de Fiscales Superiores del Distrito Fiscal de Lima Centro, entregar una copia del acuerdo a Edward Phillip Alexander Butters Rivadeneira.
El acuerdo de beneficios y colaboración Eficaz fue suscrito en el 2019 entre la Fiscalía y la empresa la Constructora Norberto Odebrecht SA de Brasil y sus sucursales del Perú. Por medio de este se ofreció beneficios de reducción o suspensión de pena contra funcionarios de la empresa.
A cambió de ello entregaría información sobre los pagos de coimas realizados a políticos y ex presidentes como Alejandro Toledo, Ollanta Humala entre otros. Esos pagos aseguraban a la empresa ser favorecidas en contratos de obras con el estado como el caso del gaseoducto sur peruano.
Los ex funcionario de la empresa beneficiados son Jorge Henrique Simões Barata, Ricardo Boleira Sieiro, Renato Ribeiro Bortoletti y Antonio Carlos Nostre Junior.
