Según el artículo 363 de la LOE, los pedidos de nulidad deben realizarse en un plazo máximo de 3 días calendario después de la elección. El pedido de nulidad, según la nota informativa del Jurado Nacional de Elecciones (JNE), fue presentado el 22 de junio al JEE. Es decir, 15 días después de desarrollado el proceso electoral. De acuerdo con la norma, el pedido de nulidad debió presentarse el 10 de junio.
Aunque el tema pueda parecer estar zanjado, la Resolución N° 09641-2026-JEE-LIC2/JNE puede ser sometida a una impugnación ante el JNE. Juntos por el Perú tiene un plazo de 3 días calendario para impugnar la resolución del JEE. El JNE tendrá 3 días para resolver la impugnación en audiencia pública.
Presunto fraude no pudo ser analizado
Un dato relevante de la resolución está referido al análisis de los fundamentos del presunto fraude denunciado por Juntos por el Perú. Los integrantes del JEE no revisaron el contenido del pedido de nulidad, puesto que no cumplió con los requisitos de forma establecidos por la ley.
La Ley Orgánica de Elecciones (LOE), en el artículo preliminar IX, precisa que la eficiencia de los actos electorales depende del cumplimiento de los plazos, etapas y formas señaladas en la Constitución y normas con rango de ley.
El cumplimiento de los plazos era indispensable para que el JEE admitiera el pedido de nulidad. De allí que el pedido de Juntos por el Perú, sin importar qué información o argumentos estuvieran contenidos en él, no fuera analizado y terminara declarado improcedente.
Además del plazo, otro requisito indispensable para que el pedido de nulidad pueda ser analizado está relacionado con el pago de la tasa electoral para el trámite del pedido. Según el fundamento 2.4 de la Resolución N.° 0941-2021-JNE, el pedido de nulidad debe estar acompañado del pago de una tasa. La omisión de este acto es causal de improcedencia del pedido.
