La próxima vez que David Espinoza Cuadra pueda caminar libremente por la calle será una adulto mayor. Tendrá poco más de 62 años, cuando recupere su libertar luego de cumplir la pena de 30 años de cárcel que le fue dictada. Su delito fue violar y asesinar con extrema violencia a su ex novia, con quien tenia una diferencia de edad de 10 años.
Las evidencias presentadas por el Ministerio Público, llevaron a los magistrados del Poder Judicial al concluir que David Espinoza Cuadra, comedio el delito de feminicidio previsto en el artículo 108 – B del Código Penal, con el agravante de violación sexual.

El titulado en Ingeniería Civil de 32 años no contento con obligar a su ex pareja de 20 años a tener relaciones sexuales, en una acción brutal la violó contra natura. Introdujo un objeto (juguete sexual) en las partes intimas de la jovencita y le causo el desgarro que le costaron la vida.
El castigo dado por este delito es no menor de 30 años prisión por la muerte y agresión sexual. Es decir al acusado se aplico el límite inferior de la sanción prevista en la ley. La máxima pena para este delito es de cadena perpetua, cuando existen dos o más hechos que hagan más grave el delito.
Violación y muerte
El violento evento se remonta al 15 de agosto del 2022. La joven mujer aceptó reunirse con David Espinoza Cuadra, en la vivienda de este en calle Berlín, en el distrito de Hunter. El motivo a decir del agresor, festejar el aniversario de Arequipa.
Días atrás la relación de ambos habían terminado. Según confirmaron testigos en el caso, la pareja convivio varios meses. Sin embargo debido a las agresiones de parte del sujeto, la joven opto por terminar la relación y se retiró de la vivienda.
El sujeto habría apelado a la convivencia de varios meses que tuvieron, para convencerla de reunirse y celebrar. Ya en escenario luego de ingerir bebidas alcohólica, el sujeto concreto la violenta agresión sexual.
Pero a partir de la evidencia, es claro que el David Espinosa, sometió a su ex enamorada quien producto del consumo del licor estaba indefensa. Sometida la joven no pudo resistir al embate del sujeto que usando juguetes sexuales la forzó contra natura.
El protocolo de necropsia confirmo que la mujer sufrió una lesión interna y un desgarro en el ano. Esas lesiones le costaron la vida a la joven. Otra prueba de la ferocidad del ataque fueron las marcas de mordida hallados en el cuerpo de la mujer.
En su primera manifestación David Espinoza Cuadra, negó la violación y aseguro que las relaciones sexuales con su ex novia fueron consentidas. Indicó que luego de intimar se quedaron dormidos y al despertar encontró la inconsciente.
Sin embargo, el relato no resulto consistente a la luz de las lesiones encontradas en el cuerpo de la mujer. Es decir, la lesiones internas producto de la introducción de objetos en las partes intimas de la difunta, golpes y mordidas en el cuerpo.
Además, se acredito que el individuo acoso por varios días a la joven, después de concluida la relación hasta convencerla de reunirse. Testigos y mensajes hallados en el celular de la joven conformaron el acoso de parte del feminicida.
