En plenos preparativos para las elecciones presidenciales se conoció que la Cuarta Fiscalía Superior Especializada en Delitos de Corrupción de Funcionarios de Lima logró que se ratifique la pena de seis años de prisión efectiva para Jonathan Guzmán, exgerente de Informática y Tecnología Electoral de la Oficina Nacional de Procesos Electorales (ONPE), por el delito de cohecho pasivo propio.

La sentencia de primeria instancia contra el funcionario público fue dictada el 9 de enero de 2025 por solicitar una coima a una candidata a cambio de manipular resultados electorales a su favor. Pese a que interpuso recurso de apelación, el órgano jurisdiccional declaró infundada su solicitud y confirmó la condena requerida por el representante del Ministerio Público.
La sentencia también confirma la inhabilitación por cinco años para ejercer cualquier cargo público. Además, deberá pagar al Estado el equivalente a 365 días de multa y una reparación civil de S/ 60 000.
LOS HECHOS
El fiscal adjunto superior Juan Manuel Fernández Castillo, a cargo del caso y del juicio oral, demostró que Jonathan Guzmán, en su calidad de gerente de la ONPE, pidió USD 60 000 a una candidata a la alcaldía de Barranca por el partido Juntos por el Perú, a cambio de manipular el sistema informático de recuento de votos y asegurarle el triunfo electoral.
Es preciso indicar que los intermediarios que promovieron la reunión entre Guzmán y la candidata —quien denunció el hecho— ya los sentenciaron por el delito de tráfico de influencias.
La contundencia de la imputación fiscal se basó en la grabación efectuada por la denunciante, cuya pericia acústica concluyó con una alta probabilidad de compatibilidad con la voz del sentenciado, así como en declaraciones testimoniales y registros telefónicos.
Este caso demuestra, por un lado, los graves niveles de corrupción que pueden intentar infiltrarse en el corazón del sistema electoral. Pero, al mismo tiempo, evidencia la capacidad del sistema judicial para investigar, sancionar y proteger la voluntad popular.
